Terms & Conditions

1.  THE PROMOTER 

The Promoter is: Fiverr International Ltd of 8 Eliezer Kaplan Street, Tel Aviv, 6473409 Israel, in collaboration with Accelerate 500 DBA 1863 Ventures (“1863”) of 1100 15th St NW, Washington, DC 20005, USA.

2.  THE PROMOTION 

2.1  The title of the promotion is The Future Collective for Black-Owned Businesses (the “Promotion”).

2.2  The Promotion begins on October 12nd, 2023  at 11 AM ET and ends on November 2nd, 2023 at midnight ET (the “Promotion Period”).  The Promoter is not responsible for late, incomplete, misdirected, delayed, or undelivered entries, including entries not timely received due to telephone failures, Internet failures or disruptions, or ISP problems. Incomplete information, regardless of cause, may result in disqualification of an entry.

The Promoter will select twelve grant applications from among those submitted during the Promotion Period via the online form (“Application Form”) available here, which satisfy the eligibility criteria set out below, and which the judging panel considers to best satisfy the judging criteria set out below. Following the Promotion Period, up to twelve selected applicants (“Grantee”), will (a) enter an accelerator program provided by Fiverr in collaboration with 1863 (the “Accelerator Program”) and (b) receive a grant of US $20,000 ($15,000 in cash and $5,000 in Fiverr Credit). 

3.  HOW TO ENTER 

3.1  To enter the Promotion, complete and submit the online Application Form on the application page.  

3.2  Application Forms may only be accepted in the English language.

3.3  No purchase is necessary. 

3.4  The Promoter will not accept:

(a)  responsibility for promotion entries that are not received, lost, damaged, or delayed in transmission, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, network, server, computer hardware, or software failure of any kind; or

(b)  proof of transmission or submission of an Application Form as proof of receipt of entry to the promotion.

3.5  By submitting the Application Form, you are agreeing to be bound by these terms and conditions, and are warranting that the information provided in the Application Form is accurate and complete.

3.6  The Application Forms submitted will be judged by a panel of judges appointed by the Promoter and 1863, at their sole discretions (the “Judges”), who will select the successful applications based on those it considers to best demonstrate the following criteria:

(a) Business Plan: their plans for business growth and how the grant will help them achieve their goals;

(b) Oraginality: How does their business differentiate or disrupt within their industry; and

(c) Purpose: The driving inspiration fueling their business vision and the impact they hope to achieve both for their customers and the broader community.

3.7 The Judges will have full authority and sole discretion to select applications that they deem successful. The decision of the Judges (acting reasonably) will be final and no explanations, correspondence or discussions will be entered into thereof.

4.  ELIGIBILITY 

4.1  The Promotion is only open to residents of the US and Canada aged 18 years or over, who own or manage a business of 1 employee or more and meet the following eligibility criteria:

(a) Identify themselves as Black or African American;

(b) Business based in the U.S. or Canada  and incorporated as a legal entity under the laws of any U.S. state or under the Canadial law, as applicable; and 51% Black-owned, managed, and controlled. Preferable to have a valid minority-owned business registration or certification, but any proof of business legitimacy will be accepted;

(c) Must have a Fiverr account with 3+ past purchases;

(d) Business in operation for at least 1 year with product(s)/service(s) ready to promote and sell;

(e) Business revenues over $75,000 in the most recent fiscal year;

(f) Willing to invest a total of 30+ hours of training, coaching, and assignments from January to June 2024 in addition to ad-hoc activities including, but not limited to, networking and content creation.

4.2 The following persons are not eligible to apply:

(a)  employees of the Promoter and 1863 or each of their holding or subsidiary companies;

(b)  employees of agents or suppliers of the Promoter and 1863 or each of their holding or subsidiary companies, who are professionally connected with the promotion or its administration; or

(c)  members of the immediate families or households of (a) and (b) above.

4.3  In entering the Promotion, you confirm that you are eligible to do so and eligible to claim any grant you may be awarded. The Promoter may require you to provide proof that you are eligible to enter the promotion.

4.4 The Promoter will not accept promotion entries that are:

(a)  automatically generated by a computer or software;

(b)  completed by third parties or in bulk;

(c)  illegible, have been altered, reconstructed, forged, or tampered with;

(d)  photocopies and not originals; or

(e)  incomplete.

4.5  There is a limit of one entry to the Promotion per person and per business. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.6 The Promoter reserves all rights to disqualify you, at any time, if:

  1. There is any reason to believe that you have violated these terms and conditions or Fiverr’s Terms of Service.
  2.  Your conduct is contrary to the spirit or intention of the Promotion.

4.7 By submitting an Application Form, you undertake that any content delivered to the Promoter in the scope of the promotion may not: (a) contain any material that is defamatory, obscene, profane, or offensive; (b) contain any false, unsubstantiated or unwarranted claims for any product or services; (c) contain any false or misleading statement or representation, including, but not limited to providing a false name or e-mail address; (d) advertise any habit-forming drug, tobacco product, weapon, firearm or ammunition; (e) violate the rights of any person, entity, firm or corporation, including intellectual property rights and any copyright; (f) disparage or libel any competitor’s products, or; (g) depict the consumption of alcoholic beverages in violation of applicable law. Application Forms in breach of the above will result in disqualification.

5.  THE GRANTS

5.1  Each of the final 12 Grantees will receive a total amount of US $20,000 ($15,000 in cash and $5,000 in Fiverr Credit).

5.2  There is no cash alternative for the Fiverr Credit grant.

5.3  The grants are as stated, must be accepted as awarded, and are not negotiable transferable, or refundable. The grants are conditioned upon the Grantee's participation in the Accelerator Program, including attendance of coaching sessions, workshops, obligations and requirements, as shall be decided by the Promoter.

5.4  All taxes, duties, fees, or other expenses associated with the grants are the sole responsibility of the Grantee.

5.5 Any business may only be awarded one grant.  Should a business submit further Application Forms such Application Forms shall not be eligible to win further grants.

5.6 To receive the Grants, each Grantee agrees to provide any documents and/or information required by the Promoter, including to complete, sign and return an affidavit of eligibility and liability/publicity release, if requested.

5.7  Fiverr Credits may be used for purchasing Gigs and/or other services offered on the Fiverr website. Your available Credit balance will appear in your account. Your valid Fiverr Credits will be automatically applied to your next purchase and can be viewed in your order summary after you place the order. Fiverr Credits issued under this promotion will expire 3 months after they are issued. Credits may be voided in the event of fraud, misuse, or violation of these Terms. The Promoter reserves the right to modify or cancel the Fiverr Credits program at any time. If you or Fiverr deactivate or suspend your Fiverr account, any unused Fiverr Credits in your account will be forfeited.

6.  SELECTION OF GRANTEES

6.1  The Grantees will be chosen as follows: First, each Application Form will be reviewed by the Judges who will choose the 30 top applicants to move on to the final selection. Then, each of the 30 applicants selected will be invited to a virtual interview, after which, based on the selection criteria mentioned above, and subject to the Judges' sole discretion, the Judges will choose the final 12 Grantees that will be invited to participate in the Accelerator Program and be entitled to receive the Grants. The decision of the Judges is final and no correspondence or discussion will be entered into.

6.2  The Promoter will e-mail the selected Grantees as soon as practicable (and in any event within 70 days of application submission), using the email address provided in the Application Form. The Promoter will not amend any contact information once the promotion entry form has been submitted. Applicants who are not selected to participate in the Program and receive the Grant, will not receive any notice stating so.

6.3 The Promoter reserves the right to add judging rounds for selecting the Grantees, at the Promoter’s sole discretion.

6.4 The Promoter Reserves the right to extend or change any deadline periods.

6.5 In case of disqualification, per any of the reasons of Section 4.6 above, the Promoter may select an alternative Grantee among the eligible applicants, based on the same selection criteria.

6.6 The Promoter will make available upon request a list of the surnames of the Grantees. Requests should be sent to futurecollective@fiverr.com.

7.  CLAIMING AND DELIVERING THE GRANTS

7.1  The prize may not be claimed by a third party on a Grantee’s behalf.

7.2  The Promoter does not accept any responsibility if a Grantee fails to take up the grant.

7.3  The Accelerator Program will begin in January 2024, Grantees will be automatically enrolled.

7.4 The Promoter shall credit each successful Grantee’s Fiverr account with their Fiverr Credit within 90 days of the beginning of the Accelerator Program.

7.5  The Promoter shall e-mail each Grantee, asking them for their US bank account details to which the $15,000 cash grant can be sent.  Provided the Grantee responds by providing complete valid bank details within 21 days of the Promoter’s e-mail requesting them, the Promoter shall send the cash grant to the Grantee in two parts, the timing of which will be at the discretion of the Promoter. The Grantee will receive the first payment within the first 90 days of the beginning of the Accelerator Program, and the second payment within the last 90 days of the Accelerator Program.

8.  LIMITATION OF LIABILITY 

Insofar as is permitted by law, the Promoter, 1863, and all their respective officers, directors, employees, representatives, and agents, will not in any circumstances be responsible or liable to compensate any Grantee or accept any liability for any loss, damage, personal injury or death occurring as a result of the acceptance, possession, use or misuse of the grant or participation in this promotion, except where it is caused by the negligence of the Promoter or 1863. Your statutory rights are not affected.

APPLICANTS ACKNOWLEDGE AND AGREE THAT THE PROMOTER HAS NO RESPONSIBILITY NOR LIABILITY WITH RESPECT TO ANY ACT OF 1863 RELATED TO THE PROMOTION AND/OR THE ACCELERATOR PROGRAM, AND FIVERR SHOULD NOT BE HELD ACCOUNTABLE FOR ANY OF 1863’S ACTS OR OFFERINGS.

Each applicant hereby remises, releases and forever discharges the Promoter, 1863 and all their respective officers, directors, employees and representatives from any and all liabilities arising or relating to the Promotion and/or the Accelerator Program, and hereby indemnifies and holds harmless the Promoter and 1863 from and against all claims, liabilities, damages or losses of any kind. Both the foregoing release and indemnity include injury, death and property loss, arising from or in connection with: (i) acceptance, possession, use or misuse of any grant; (ii) participation in the Promotion and/or the Accelerator Program or any related activity, as well as claims based in whole or in part, directly or indirectly, upon receipt, enjoyment, ownership, possession, use, misuse or inability to use any grant; (iii) whether under contract, tort (including negligence), warranty or any other applicable sources of law; (iv) any condition caused by events beyond the Promoter and/or 1683 control that may cause the Promotion and/or the Accelerator Program to be disrupted or corrupted; and (v) any printing or typographical errors in any materials associated with the Promotion and/or the Accelerator Program.

9.  OWNERSHIP OF PROMOTION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS 

9.1  The Promoter and/or 1863 do not claim any rights of ownership in your promotion entry.

9.2  In order to advertise the promotion, you agree that the Promoter and/or 1863 may, but are not required to, make details of any successful Grantee’s entry available on the website fiverr.com and on their respective social media pages, and in any other media, whether now known or invented in the future, in connection with any publicity relating to the promotion. You agree to grant the Promoter and/or 1863 a non-exclusive, worldwide, irrevocable license, for the full period of any intellectual property rights in the promotion entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-license the promotion entry for such purposes.

10.  DATA PROTECTION 

10.1  The Promoter will only process your personal information as set out in Fiverr’s Privacy Policy.

10.2  The Promoter will process your personal data included in the Application Form:

(a)  for the purposes of running, judging, and administering the promotion, which are necessary for the purposes of compliance with our obligations under the contract between us; and

(b)   (if you are a successful Grantee), for the purposes of reasonable promotion and marketing of the Promoter relating to this promotion, which may include sharing your name and application to the Promoter community and press, and for the purposes of promoting your business, both of which are necessary for the purposes of legitimate interests pursued by the Promoter.

11.  SUCCESSFUL GRANTEES’ FUTURE PARTICIPATION IN FIVERR’S MARKETING ACTIVITIES

11.1 By accepting a Grant and participating in the Accelerator Program, each Grantee grants to Fiverr, where permitted by law, the right to use and publish (worldwide, via the Internet and otherwise) his/her name, city and state of residence, portrait, image, picture, voice and likeness for promotional purposes without prior notification, review or approval and without payment or consideration.

11.2 Each Grantee further agrees, as may be reasonably requested by Fiverr, to provide comments about Fiverr and/or the Accelerator Program to the press without further compensation, in connection with any publicity relating to the Promotion and/or the Grant.

12.  GENERAL 

12.1  If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Promotion.

12.2  The Promoter reserves the right to hold void, suspend, cancel, or amend the Promotion and/or change these terms and conditions and/or extend or change any deadline periods, should circumstances so require, at any time, without notice nor obligation to justify our decision and we will not be held responsible for it.
